Unions are preparing to help members claim against employers for holiday pay and overtime they are owed under EU law, after the ECJ ruled earlier this year that staff who receive part of their earnings in commission should have this taken into account when holiday pay is calculated. Employment law experts believe the ruling could set a precedent which would see other variable allowances, such as regular overtime or performance related pay, included in holiday pay calculations. Unite has now produced draft pro-forma letters that could be presented to employers warning them of their “obligation to pay holiday pay at the same rate as normal pay.”
