Hoteliers struggle with unfavourable reviews

Simon Calder discusses the policy of fining hotel guests for posting unfavourable comments online, in light of the case of Tony and Jan Jenkinson, who had their credit card charged £100 by the Broadway Hotel in Blackpool for describing the hotel on TripAdvisor as a "filthy, dirty rotten stinking hovel run by muppets!". Gary Rycroft, a partner with the Lancashire solicitors Joseph A Jones & Co said the penalty was legally unenforceable under the Unfair Contract Terms Act 1977. However, he reminds users of sites such as TripAdvisor that the law favours hoteliers where unfair or fake reviews are posted.
