The Evening Standard’s Antony Hilton examines the law covering holiday pay in the light of recent cases bought by the GMB and Unite unions, which claim that holiday pay should be calculated on the basis of total regular earnings rather than basic minimum pay. Edward Goodwyn of Pinsent Masons says a judgment in the case is expected by the end of this month. Mr Hilton notes that if the case does find against the employers, “the implications for British business are “huge”. He says that any compensation claims are likely to prove “particularly contentious as employers have complied fully with British law and it is hardly their fault if British law turns out to have been wrong.”
